CiNKO Notice Regarding Electronic Signatures and Electronic Communications
YOUR CONSENT TO ELECTRONIC DELIVERY
(“Consent Form”)
You are applying for a CiNKO Spend Card. If you consent to this Statement of Consent for this Program, such consent shall apply even if you do not obtain (or are not offered) a CiNKO Spend Card.
In this Statement of Consent, the terms “we,” “our,” and “CiNKO” refer to: CiNKO, its related affiliates, and service providers.
Your express consent to this Notice of Electronic Signatures and Electronic Communications (“Consent”) authorizes CiNKO to provide you with Communications electronically, allows you to sign and authorize Communications electronically through the use of the CiNKO mobile application or other APIs provided by CiNKO (the “Mobile Application”), and allows CiNKO and its partners to collect such electronic signatures.
If you do not consent to the electronic delivery of Communications, you will not be able to use, or will not have full access to, your CiNKO Spend Card.
By applying for a CiNKO Spend Card and CiNKO’s related services, you agree that such registration constitutes your electronic signature and consent to our providing notices and communications to you electronically. Where applicable, you also consent to the electronic delivery of notices to Company Administrators and Company Users, including those required by law, and warrant that such Administrators and Users consent to receiving electronic notifications.
You understand and agree that this consent has the same validity and legal effect as a handwritten signature.
You have the right to receive legal disclosures, notices, and communications (collectively, the “Covered Documents”) in paper form by mail. However, we may provide you with such Covered Documents electronically if you: (i) provide your Consent to do so; and (ii) comply with the System Requirements detailed below.
For the purposes of this Statement of Consent, Covered Documents include all communications related to the administration and collection of your account, as well as all legal disclosures, notices, and communications that we are required to provide to you in writing regarding your account.
Validity of Consent
Your Consent will remain in effect until any of the following circumstances occur:
1. You or we terminate the CiNKO Spend Card Program or your CiNKO Spend Card; or
2. You withdraw your consent to receive electronic communications.
If you cancel your CiNKO Spend Card, your Consent will remain in effect with respect to CiNKO’s rights prior to such cancellation (including those arising from this Statement of Consent).
Please refer to the Terms and Conditions of your CiNKO Spend Card for information on how to cancel your card.
Methods of Delivering Covered Documents
In this document, the term “provide” means to deliver, make available, send, notify, or any similar term.
We may provide you with the Covered Documents electronically via downloadable files from our website, including files in PDF format.
It is your responsibility to review the Covered Documents in a timely manner so that you may take the appropriate action.
Access to Paper Copies
You may make copies of the Covered Documents using the “print” or “save” functions available in the application through which you view such documents (e.g., a web browser or Adobe® Reader®).
We will retain copies of the Covered Documents for the periods required by applicable law and will provide them to you upon request within those periods.
We do not guarantee that we will retain copies for a period longer than required by law. We recommend that you save or print copies of the Covered Documents so that you have them available when you need them.

CiNKO's Right to Submit Paper Documentation
We reserve the right to provide you with the Covered Documents in paper format at any time and at our sole discretion, even if you have given your Consent to receive them electronically.
For example, and without limitation, we may do so in the event of system failures or suspected fraud.
Hardware and Software Requirements
To access and retain the Covered Documents, you must have a computer or communication device that has:
• Working Internet access;
• A web browser compatible with 128-bit encryption (compatible with the latest versions of Chrome®, Firefox®, Microsoft Edge®, or Safari®);
• 16 MB of available memory (32 MB of RAM recommended); and
• A program that allows you to view, save, and print PDF files (such as Adobe® Reader® version 4.0 or higher).

By giving your Consent, you confirm that you meet all of the System Requirements listed above.
Withdrawal of Consent
You may withdraw your consent at any time and at no cost.
If you withdraw your consent before your CiNKO Spend Card application is approved, this will prevent you from accessing certain features of the CiNKO Spend Card, either in whole or in part.

If you withdraw your Consent, the validity, effectiveness, and legal enforceability of any electronic disclosures made prior to such withdrawal will not be affected.
Confirmation of Ability to Access and Consent to Electronic Communications
By confirming that you have read and accepted these terms, you represent and warrant that:
1. You have access to a computer system that meets the requirements set forth above;
2. You agree to receive the Covered Documents electronically; and
3. You have the ability to access, print, and/or store the information provided electronically.
